The Terms of Use set forth herein (hereinafter, the “Terms”) constitute an agreement between You and Lastel Limited, a professional recruitment agency (hereinafter, “We”, “Us”, “Our” or “Lastel”). These Terms explain the terms and conditions by which You may access and/or use Our website located at https://lastel.ie (hereinafter, the “Website”).

Please, read these Terms carefully before accessing the Website. These Terms are supplemented by Our Privacy Policy which governs the use of the personal data we collect through the Website or otherwise.

By accessing the Website, You signify that You have read, understood, and agree to be bound by all of these Terms.

We reserve the right at any time to change these Terms. Any changes We make will be effective immediately. Your use of the Website after such changes will be deemed acceptance of changed Terms. You are solely responsible to review these Terms for the latest version periodically.

Use of the Website

You are able to view Website without any registration. The Website includes functionality that enables You to upload Your content and download any materials, fill out any forms and submit any other information or content through the Website and some services, that must be carried out in strict compliance with these Terms. If You want to access, order some services or to upload Your content, You may be asked to fill out the special forms at the Website and provide certain personal details or other information. It is a condition of Your use of the Website that all the information You provide during submission of the forms is true, correct, current and complete. Lastel provides content, information and materials through the Website that are the copyrighted and/or trademarked work of Lastel or Lastel’s third-party licensors, including, but not limited to clients of the Lastel (hereinafter, collectively, the “Materials”). Materials are protected by the Republic of Ireland and international law. Materials may include logos, graphics, video, images, software, questionnaires, and other content. Subject to the terms and conditions of these Terms, and Your compliance with these Terms, hereby We grant You a limited, personal, non-exclusive and non-transferable, non-assignable, revocable license to access and use the Website, to use the Materials print, make the screenshot or download one copy of a reasonable number of pages of the Website, in each case solely in accordance with these Terms.

Except for the foregoing license, You have no other rights on the Website and You may not modify, edit, copy, reproduce, create derivative works of, reverse engineer, alter, enhance or in any way exploit any content of the Website or Materials in any manner, use the Materials for any commercial purpose, or for any public display (commercial or non-commercial), remove any copyright or other proprietary notations from the Materials or transfer the Materials to another person or “mirror” the Materials on any other server.

By submitting to Us any resources, information, ideas, notes, concepts, trademarks, service marks or other materials, including, except for any personal information which is governed by Our Privacy Policy (hereinafter, collectively, “Content“), or by posting such Content to any area of the Website, You grant Us an unrestricted, irrevocable, perpetual, non-exclusive, fully paid and royalty-free, license (with the right to sublicense through unlimited levels of sublicenses) to use, copy, perform, display, create derivative works of, adapt and distribute such Content in any and all media (now known or later developed) throughout the world.

You agree that this license includes the right for Us to provide, promote, and improve Lastel, Our Website and to make Content submitted to or through Lastel available to other companies, organizations or individuals, including clients of Our Lastel.

Disclaimer of Warranties

Your use of the Website its content, the Materials or items obtained through Our Website is at Your own risk. The Website, it’s content, the Materials or items obtained through Our Website are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. Lastel expressly disclaims all warranties,either express or implied, with respect to the Website, its content, the Materials or items obtained through Our Website to the maximum extent permitted by the applicable law, including, however not limited to, warranties of merchantability, fitness for particular purpose, non-infringement, and title, and warranties arising from course of performance, course of dealing, usage or trade.

Limitation of Liability

Lastel is not responsible for the truthfulness, accuracy and correctness of the information provided on the Website. In no event will the Lastel, its licensors, service providers, employees, agents, officers or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with Your use, or inability to use, the Website, any websites linked to it, any content on the Website or such other websites, Materials or items obtained through the Website or such other websites, including any direct, indirect, special, incidental, consequential or punitive damages, including but not limited to, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable. Lastel may terminate or suspend Your access to the Website, and the Materials at any time, with or without cause or notice. Upon any such termination or suspension, Your licence to access and use the Website will immediately cease; Lastel will be under no obligation to maintain or provide You with access to any Materials, and may retain or delete such Materials in Lastel’s sole discretion.

Governing Law & Dispute Settlement

These Terms will be governed by and interpreted in accordance with the laws of the Republic of Ireland. Other matters not covered by these Terms will be governed and interpreted in accordance with the laws of the Republic of Ireland as well.

Lastel and You will make every effort to resolve any dispute that may arise in connection with these Terms through negotiation.

If the dispute is not settled by the means of negotiations in 30 days, the dispute will be settled by the respective Court of the Republic of Ireland. The applicable law will be the law of the Republic of Ireland.

Miscellaneous

These Terms and Privacy Policy constitute the entire agreement between the Parties hereto pertaining to the subject matter hereof and shall supersede any prior written or oral agreements between the parties. Your rights and obligations granted under these Terms are not assignable, transferable or sub-licensable by You without Lastel’s prior written consent. Any heading, caption or section title contained in these Terms is inserted only as a matter of convenience and in no way defines or explains any section or provision hereof.

These Terms do not, and will not be construed to, create any partnership, joint venture, employer-employee, agency or franchisor-franchisee relationship between You and Lastel. We may assign, transfer or sublicense any or all of Our rights or obligations under these Terms without restriction. No waiver by either party of any breach or default under these Terms will be deemed to be a waiver of any preceding or subsequent breach or default.

If any provision of these Terms is found to be unlawful, void or for any reason unenforceable, that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provision

The Website may make available or provide links to third party websites. These links are provided for Your convenience and do not signify that We endorse such third party websites. We have no control over the contents of those websites and accept no responsibility for them or for any loss or damage that may arise from Your use of them.
